FBR cuts super tax rate, offers exemption to major export-oriented businesses

FBR has reduced the highest super tax rate to 8% and exempted qualifying exporters, while introducing changes to audits, ATL surcharges and property purchases.

ISLAMABAD (Web Desk) –  The Federal Board of Revenue has revised income tax rules, offering super tax relief to highly export-oriented businesses while lowering the maximum rate for other eligible taxpayers.

The Federal Board of Revenue (FBR) has introduced major amendments to Pakistan’s income tax framework, providing relief to businesses with a strong export focus while reducing the highest super tax rate applicable to other covered taxpayers.

Under the revised provisions, taxpayers with income exceeding Rs500 million may qualify for an exemption from super tax if their export proceeds account for more than 80 percent of their total turnover.

The measure is aimed at businesses that generate most of their revenue from international markets and could provide significant relief to companies operating in export-oriented sectors.

The export condition means the exemption will not apply automatically to every business involved in overseas sales. Companies must meet the specified threshold, ensuring that the incentive is primarily directed toward taxpayers whose operations are heavily dependent on exports.

For taxpayers with income above Rs500 million who do not qualify for the export-related exemption but remain subject to super tax, the highest applicable rate has been reduced from 10 percent to 8 percent.

The changes come as Pakistan continues efforts to increase exports, improve foreign exchange earnings and strengthen the competitiveness of domestic businesses in international markets.

The revised tax treatment could have a notable impact on large companies, particularly those with substantial export revenues. Lower tax liabilities could potentially provide businesses with additional resources for investment, expansion and production capacity.

The FBR has also made changes to provisions governing tax audits and the verification of financial records.

Under the revised framework, taxpayers’ accounts may be subjected to another audit in specified circumstances. However, prior approval from the relevant chief commissioner will be required before such action is undertaken.

The amendments also provide for the revaluation of inventory and reassessment of actuarial values where circumstances require such measures.

Another procedural change gives taxpayers the right to raise objections against the appointment of a particular auditor. The provision introduces an additional safeguard within the audit process and gives taxpayers an opportunity to challenge an appointment where they believe legitimate concerns exist.

The changes indicate an attempt to strengthen tax administration while providing procedural protections to taxpayers facing audits and related proceedings.

In a separate measure, the FBR has increased the surcharge applicable to individuals who are not included in the Active Taxpayers List (ATL).

The ATL is used by the tax authorities to identify taxpayers who have complied with specified filing requirements. Individuals outside the list can face higher tax rates or surcharges on certain transactions under Pakistan’s tax framework.

However, the revised rules include a mechanism allowing eligible individuals to seek an exemption from the surcharge related to property purchases through a written undertaking.

Under the arrangement, a person seeking the exemption will be required to undertake to purchase the property within six months, subject to the conditions prescribed under the applicable rules.

The measure provides a route for qualifying individuals to avoid the additional burden where they meet the stated requirements and complete the property transaction within the prescribed period.

The latest amendments form part of wider efforts to reshape Pakistan’s tax system by combining revenue collection with incentives for documented economic activity and export growth.

For exporters, the super tax exemption could make a significant difference where companies meet the strict 80-percent export threshold. For other large taxpayers, the reduction of the maximum super tax rate provides comparatively broader relief.

At the same time, changes to audit procedures and ATL-related surcharges demonstrate that the FBR continues to focus on compliance and documentation.

The revised framework is expected to attract attention from large businesses, exporters, tax professionals and property buyers as taxpayers assess how the amendments affect their financial and compliance obligations.
