LAHORE – Pakistan Tehreek-e-Insaf leader Sanam Javed has approached a family court in Lahore seeking dissolution of her marriage through khula, with the court admitting her petition for hearing and issuing a notice to her husband.
Javed, who is currently held at Kot Lakhpat Jail in Lahore, filed the petition through her lawyer, Barrister Khadija Siddiqui.
The court has directed her husband, Ateeq, to appear on November 25 to respond to the proceedings.
According to the petition, differences between the couple developed over time because of a lack of mental compatibility and growing misunderstandings. The disagreements reportedly intensified and created persistent discord in their relationship.
Javed has told the court that the circumstances have made it impossible for her to continue the marriage. She stated in the petition that she has developed intense feelings of hatred towards her husband and can no longer live with him as his wife.
The petition further maintains that she is unable to continue the marital relationship within the limits prescribed by Islamic teachings. On these grounds, she has requested the court to grant a decree of khula and formally dissolve the marriage.
The couple married on September 22, 2009, in accordance with Islamic law and have two children, according to the petition.
Court proceedings
The court’s decision to admit the petition means the matter will proceed to a hearing, during which the parties will have an opportunity to present their positions.
The notice issued to Ateeq requires him to appear before the court on November 25. His response and any further proceedings will form part of the legal process before the court considers the request.
Khula is a legal mechanism through which a Muslim woman can seek dissolution of her marriage through a court. Family courts examine such petitions under the applicable legal framework and follow the required procedure before issuing a decree.
The proceedings are separate from any criminal or political cases involving the petitioner. The court’s consideration of the marriage petition concerns the personal legal relationship between the parties.
No further details about the couple’s private disagreements or the circumstances leading to the petition were included in the information provided to the court.
Sanam Javed’s legal situation
Javed’s current detention at Kot Lakhpat Jail places the family court proceedings within a broader period of legal difficulties for the PTI leader.
Her request for khula is a separate matter from her political activities and other legal proceedings. The family court will consider the petition according to the relevant procedures, regardless of the separate issues surrounding her detention.
The case also highlights the role of family courts in resolving marital disputes and considering applications for dissolution of marriage. Such proceedings require the court to examine the petition and follow the prescribed legal process before reaching a decision.
The November 25 hearing is expected to be an important next step, as Ateeq has been directed to appear before the court.
Until the proceedings are concluded, the requested dissolution remains a matter before the family court. A final decree will depend on the court’s consideration of the petition and completion of the applicable legal requirements.
Neither a final decision nor further details about the husband’s response were included in the information available at the time of the filing.
